Additional information is provided through the research efforts of Hisxmark.com and Webmaster, Charles H. Murphree, by accessing publicly available resources. Published information regarding living individuals is limited to a small subset (i.e., name and family relationships) disclosed through the genealogy records published online. For all genealogy records, public disclosure is limited to demographic data (e.g., name, title, date and location of birth, marriage, and death), as well as family relationships that would be of value for other family researchers. Contact information for contributors is not published directly, and is not provided in response to visitor queries without contributor's permission. Queries regarding instances of genealogical data are forwarded to the appropriate contributor who may choose to respond or to ignore the query. Additional non-demographic or private family information provided by contributors (e.g., notes, memos, additional private references) is retained by Hisxmark.com in a secured environment for reference and to assist with family genealogical and historical research as appropriate.
Usage by Type of Information
1. Totally Private Information. Hisxmark.com does not share any of the information about you that would not be known to others with anyone outside of Hisxmark.com without your informed consent. Examples of this information include electronic mail (e-mail) communications or your web browsing activity. Exceptions to this policy are:
A. With your explicit permission, such as when you press "Send" to send an e-mail message (which will have your e-mail and registered name attached) or when you elect to fill in information requested by us or another party that is specifically intended to be provided to a third party (i.e. subscriber mailing lists or bulletin board postings).
B. When you have provided information for the explicit purpose of having such information included in the Site genealogy records for publication to our public areas.
C. When required by applicable law, regulation, legal process or governmental request to disclose such information to law enforcement authorities.
2. Personal Information. Hisxmark.com considers your name, address, phone and other contact information to be confidential and does not disclose such information without your informed consent.
3. Correcting Information. Hisxmark.com wants any information you provide or information about you (e.g. names, dates, etc. in genealogy databases) provided by others to be correct. We provide you with the ability to change the information we have about you. You must identify yourself before we give out any information. Please contact the Webmaster to provide us with any new information, or change the information yourself by using the links or submission forms on appropriate Site pages. We reserve the right to reject or remove any content posted on our Website at our sole discretion.
4. Aggregate Information. Hisxmark.com aggregates certain non-personal information pertaining to the usage of its service. Such aggregate information does not contain user-specific information that reveals any specific visitor's identity. Hisxmark.com may share this information with anyone since it does not personally identify you.
Access to Information
1. Access by Unauthorized Individuals. Hisxmark.com does its reasonable best to protect its visitors' and contributors' privacy by using technologies and processes such as encryption, access control procedures, network firewalls and physical security. These technologies and methods increase the security and privacy of information but cannot guarantee absolute confidentiality or security of information.
2. Hisxmark.com Communications. If requested by Site visitors, Hisxmark.com may introduce a subscriber mailing list to notify subscribers (the Subscriber) when changes are made to the Site. If a mailing list is installed, Hisxmark.com may choose to communicate directly with its mailing list Subscribers via e-mail regarding certain information that Hisxmark.com deems of value and interest to its users. In these rare instances, Hisxmark.com will send such information itself so as to ensure the protection of this information, and will not disclose the Hisxmark.com Subscriber mailing list to third parties.
3. Other Access by Hisxmark.com. Site visitors may complain about being the target of certain unwanted or illegal behavior coming from a Site visitor, such as personal attacks or abusive language in bulletin boards. In such instances, Hisxmark.com, through its Webmaster, reserves the right to remove any inappropriate postings, to inspect any visitor information necessary to investigate any allegations or complaints received by the Webmaster, and to respond regarding actions taken to resolve a complaint.
